2014 Municipal Election


Compliance Audit Committee

A  joint Municipal Elections Compliance Audit Committee (MECAC) was established between the Region of Waterloo, Cities of Cambridge, Kitchener and Waterloo and Townships of North Dumfries, Wellesley, Wilmot and Woolwich.

If an eligible elector believes, on reasonable grounds, a candidate has contravened a provision of the Municipal Elections Act relating to campaign finances, he/she can request a compliance audit of the candidate's finances. Within 10 days after receiving the application the Township Clerk shall forward the application to the MECAC. Within 30 days after receiving the application the committee shall consider the application and decide whether it should be granted or rejected. If the committee decides to grant the application, it shall appoint an auditor to conduct a compliance audit of the candidate's election campaign finances. Within 15 days of the Committee's decision, the decision may be appealed to the Ontario Court of Justice and the court may make any decision the Committee could have made, that is, it can order an audit or decline an audit.

  • Staff costs included:  meeting attendance, agenda preparation and circulation, minute transcription, training, consulting with the Provincial Policy Advisor as well as legal services and other municipalities, updating the website and file management, responding to requests from the public and MECAC members, and obtaining quotations for audit services.
  • Legal costs included the cost of having SmithValeriote staff give advice to Township staff and the audit committee (both verbal and written) and attendance at MECAC hearings.  Sandy Shantz and Mark Bauman paid for their legal expenses.  Sandy Shantz paid for the audit that she commissioned directly.
  • MECAC expenses included $150 per member per hearing attended plus mileage.
  • The Audit Expense was the total amount charged by Froese Forensic for the audit conducted of Scott Hahn's campaign finances.

Total expenses in 2015 amounted to $53,300.

Financial Statements

Every candidate is required to submit a financial statement by 2 p.m. on March 27, 2015, regardless if they withdrew their nomination or extended their campaign. Pursuant to Section 88(9.1) of the Municipal Elections Act, 1996, financial statements as filed by candidates are being posted for public viewing.The statements are saved in PDF format. Financial Statements are available in alternate formats or large print by contacting the Clerks Office.

An elector who is entitled to vote in an election and believes on reasonable grounds that a candidate has contravened a provision of the Municipal Elections Act relating to election campaign finances may apply for a compliance audit of the candidate's election campaign finances. An application for a compliance audit shall be made to the Clerk and it shall be in writing setting out the reasons for the elector's belief. The application must be made within 90 days of the filing dates under section 78 of the Municipal Elections Act.
